Captain Casimir Stanislas D'Arpentigny the founding father of French Chirology.

D'Arpentigny was the first person to formulate of a system of hand shape classification. Despite the fact that hands clearlycome in different shapes and sizes, no-one had previouslydetermined to consider this obvious and distinctive fact. Thechiromancer's preserve had been with the lines of the palm, notwith the form of the hand in which those lines were to be found. From his own observations, D'Arpentigny delineated six basictypes of hands, the spatulate, the conic and the square, basedprimarily on the fingertip shapes, the knotty and the psychic, based primarily on the quality of the fingers, and the elementary, based on the overall crudity and width of both the palm and thelines. This hand shape typology has been widely adopted and isstill used by many palmists today.

Once again Anthony I notice you have copied and pasted from www.cheirology.net
via Johnny's website.

I've just had a look through some of your articles and documents on scribd eg your 'COMPLETE SCIENTIFIC PALMISTRY PART IV'. I see reams and reams of stuff that you copied word-for-word from other websites, without any credit to the authors, apart from a bibliography at the end.

Please understand that, even when you link to your sources, copying and reproducing entire pages & chapters from books and websites, without permission of the author or whoever owns the copyright, is copyright theft.
This is pointed out in the rules on scribd

Dear Lynn:

I have mentioned these sources in the bibliography and have taken the permission of Johnny Fincham and Jennifer Hirsh for their material. They are notes or compilations for my students. You may please advise me and I will definitely correct myself. I have never taken credit for this writing. The true fact is that it is just what I am teaching and I have mentioned it in the beginning. I just happened to teach and students did not have material of scientific research. You may please advise me accordingly.

Captain Casimir Stanislas D'Arpentigny Empty Re: Captain Casimir Stanislas D'Arpentigny

Post  jophiel Fri Jan 27, 2012 2:42 pm

Dear Lynn

This is what I have written to my students:

ACKNOWLEDGEMENT WITH DEEP GRATITUDE
At the outset I have to openly confess that Part V of Scientific Palmistry has seen the light of the day due to
the help and support of two palmists, chirologists and researchers, whose names, along with their
photographs and books, are displayed below. They have been kind enough to permit me to incorporate their
material in my writings. I am ever grateful to them for such a big favour, which will go a long way to benefit
our students in India and elsewhere and the spread of Elemental Chirology globally.

Her permission and blessings
“Jennifer Hirsch to me 30/06/2010
Beloved Anthony , Yes the material in my books and training
manual is for anyone who is interested I am happy and grateful
to you if you share it.
Love and peace
Jen”
Jennifer’s books:
1. 5 Element Cheirology-The Healing Craft of Hand
Reading
2. 5 Element Cheirology: Traits of Being A to Z
3. God Given Glyphs

His permission
“Johnny Fincham to me 27/12/2010
HI Anthony, thanks for your e mail. You are very welcome to use
material from my book in your teachings. Especially if you
recommend my book to your students. All best wishes to you and
hope your course goes well. Johnny Fincham”
His blessings
Johnny Fincham to me 30/12/2010
“Hi Anthony, thank you for your kind words. You are so correct
when you say how scientific investigation is the key to study and
expertise in palm reading. I am sure your students will blossom
under your teachings. best wishes, Johnny FIncham”

do not have to elaborate anything further as we all have the blessings of these great chirologists and researchers whose aim in life is to spread knowledge with a scientific temperament and at the same time “upl ift humanity”. I strongly recommend that their books be read as they have eneavoured to decode many of the secrets through scientific study “at the roaring looms of Time”.

espite all this, I insist that they read the original mentioned in the bibliography. All this is done for working students.

Dear Lynn, I have never taken any credit for anything. I am just a teacher and students did forced me to write something. It happened this way. May be my method is wrong.

Still I ask your advise and I am ready to remove the write ups once and for all.

Thanking you and with very warm regards.

Anthony Writer.

Hello Anthony,

After reading your statement above... I am sorry, but Lynn's observations are correct:

Johnny Fincham has not allowed you to use materials from his website, because in the email copy that you received from Johnny (see below) he only confirms that it is okay for you to use materials from his books only.

However, Johnny did not allow you to use his website for this purpose... and Johnny's comment makes sense: because a very large part of the materials on Johnny's website concern materials that are the work of Christopher Jones (who gave Johnny permission to use those materials).

So, after Christopher asked you to delete all copies of his materials from you documents... I think you probably misunderstood the implications of his request:

You can no longer use any materials from Johnny Fincham's website.

Dear Anthony, because I realize that this has now become a time-consuming issue for various respected forum members (especially for Lynn & Christopher), I feel urged to make you the following request from my side is necessary:

Anthony, please make sure that ALL materials taken from Johnny Fincham's website copied to your SCRIBD documents are deleted, because otherwise we can not continue to allow you to promote your materials at this forum (which could also have implications for your membership at this forum + your position in the Global Palm Reading Network at HandResearch.com).

I respect your intentions, but I think you should try to act more conscientious regarding your 'copy-and-pasted' materials from books & websites. Because now your documents appear to have become a burden for various members of this forum.

I hope this makes sense for you now?

Hi Anthony,
I hope you stay at the forum, please do not leave on my account!
re
If you still feel that I am on the wrong side, you may please delete the article. To speak very franlkly, I really do not want to hurt anyone's feelings and interest.. I assured you earlier that I will give credit to the source. I stated openly that I collect material and share material.
Please advise me accordingly.
It's not about what I or anyone feels, it is about the law. I am just trying to make you aware of it, out of respect for original authors whose work may have been copied without permission, and for your own sake (and anyone else who copies from other people's books and websites without permission) - you don't want to put yourself in a position where you could be sued!

some extracts from the copyright rules on scribd
http://support.scribd.com/entries/25445-what-happens-when-i-upload-content-for-which-i-don-t-own-or-control-the-copyright
Distributing copyrighted content without the copyright owner’s permission is copyright infringement even if you give the document away for free.

There is no exception for the unauthorized copying and distribution of copyrighted content for educational or non-commercial use.

You can be liable for copyright infringement even if you give attribution to the owner or author of the copyrighted content.

re

Anthony, you know I have applauded you in the past for your enthusiasm about palmistry, for trying to make it available to all, and for articles where you have made a small extract of a couple of sentences and quoted your sources with a link to the original document.
I think the problem is that perhaps you weren't aware of copyright law, perhaps did not realise that it is NOT OK to copy vast amounts of text from other people without their persmission - even if you quote the source.

I don't think your students forced you to copy and paste things! Wink I am also a palmistry teacher - I don't photocopy books or copy websites, I read and study and learn and then write the information for my students in my own words.

Although you made a long bibliography, not all sources are quoted there (did I miss Christopher or Johnny getting a mention for the extensive history section?). You have copied pages and pages into that document from various sources - your students will not know which chapter or paragraph came from which source. And still there is the question of whether you were authorised to copy it anyway? I am assuming you did not get permission from everyone, because I know some of the authors whose work you have used, and I know that they do not give permission for their work to be copied by anyone, anywhere.

Sorry if I sound like "the palmistry police". Captain Casimir Stanislas D'Arpentigny 1
Wink I am just trying to make you aware of the legal aspects that apply to us all, so that you/ we all can continue to 'spread the word' about palmistry without infringing copyright.

Anthony Writer.

Hi Anthony,

I hope you decide to stay a member of the forum!

I think there has been a big misunderstanding and some meaning of words got lost in translation somewhere.

I think you, like others here, are sincere in wanting to share information with others when you come across it. From other member's requests, it is obvious that access to material and information isn't as easily obtained to everyone around the world, as it may be to people in other areas. I must confess that when you posted a link for Holtzman's book I rushed over to get a glimpse as his books are expensive, limited editions and hard to find. (and secretly disappointed not to find it Wink )

Yet, there are a couple of issues that result from copying other people's published information without explicit permission. I don't think Jenny and Johnny actually gave you permission to use their material as a sort of (large) hand out sheet for your students. I think they were thinking you wanted to teach your students what you had learned from reading their books and would recommend their books to your students for purchase.

The other issue is that in the US there are several very far reaching laws that recently were brought to the table (thankfully rejected for the moment) that would really affect how we use the internet. Most of our famous people section would have to be deleted because there is just about no credit for the photographs that have been found on the internet. I'd have to redo my web site and delete other material around the web as would many other internet users. Soon it could only be legal to post your own words and images with the risk of having your site deleted otherwise.

Because of the risk of restrictive and punitive laws being put into place we all need to be careful and mindful of how we use material we find.

Didn't mean to get on a soapbox and I'm sure Anthony that there are many who most likely appreciated your attempt to share information.

You mentioned toward the end of your post that you may be doing it the wrong way. A suggestion might be for you to do a review of the information you find. Writing in your own words what you think of the material. Provide links to resources and include brief quotes from the material with proper credit.

Hope you stay with us and continue your quest to enlighten others!

well said Patti :=D>:

As Martijn said, ALL the scribd articles/ Anthony's account seem to have been deleted, and Anthony seems to have disappeared from other palmistry groups & my facebook friend list - not sure if he has left facebook or blocked me.
If you are still here reading this Anthony, I hope you noticed Patti's solution - to
do a review of the information you find. Writing in your own words what you think of the material. Provide links to resources and include brief quotes from the material with proper credit.

Dear Lynn and Patti

Thank you for writing to me.

Let me emphasize once again that in India students do not have access to material despite the fact that they want to study palmistry scientifically. I made a lot of efforts over the years and serious students appreciated it. Apart from this, they are working students. Life here is not that easy. They go to work in crowded trains and other mode of transport. They do not have the material. I used to share whatever material I have. To inform you further, I too had a lot of problem in collecting material. I could not afford books. I will not hide the fact that I used to collect books from street vendors. Today they are prohibited from selling them on the streets. I used to collect books from the new and second hand stores, just because I could not afford new books. Considering these facts and very hard experience, I used to share material, that too in abridged form, so that students could get access to them.

Further, I really do not know much of copyright laws and I thank you for giving me an insight to it. On this count, I have not accused either of you. On the contrary I count stars even during the daylight when I think of these laws.

When I said "isolation", it means a kind of retreat, where I could ponder on my lapses and find ways and means to have a clear-cut way ahead. I am only concerned about my posts; they should not have lapses again.

At this age, I do not have ambition as a writer. Therefore, I always mention "notes for students" and the word compilation. I was on on Facebook long ago, but I used to desist from writing. As the number of students grew there, we used to communicate on that platform.

So far as bibliography is concerned, I have spread the books and authors in the five sections. I have to admit that I am a bit temperamental and lapses have occurred. So far as Dr. Arnold Holtzman is concerned, I have taken his permission to use his material.

I want reiterate once again that I have neither any intention of hurting anyone nor denying them their due credit.

Thanking you once again for your good words and advice and request you to guide me in future too.

With very warm and respectful feelings,

Anthony - Johnny cannot give you permission to use my material for one simple reason; its not his. You have to seek that permission from me, and you have not! You don't have my permission to use my material, as we have already discussed by email. For you to send me an email saying you have removed all my material and then to find yet more articles with 30+ pages of my History of Handreading material inserted into them without any referencing or acknowledgement just beggars belief.

I have known Johnny for 23 years. He was a student of mine and a colleague at the old Cheirological Society and the books he has written follow closely to the structures created by myself in teaching the beginner's course material over 20 years ago. When his first book was published, I offered him the material he has posted at his site as a gesture of support. You will notice that Johnny is always careful to cite his references and acknowledge his indebtedness. If he is indeed your hero in the handreading world, then you should learn this lesson from him too.

Dear Sir:

I was in touch with Johnny Fincham for long. I did write to him for the permission. I was really ignorant of this fact that you have stated.

In a later article, after knowing the fact, I have acknowledged you name with you link to my students.

I feel very sad and bad to be involved in such an error with a great personality like you. In future whenever I need refer anything to my students, I will definitely seek your permission and errors of this nature will not occur. I also feel proud to know that you are so learned and knowledgeable.

With very warm and respectful feelings and a prayer that the Almighty showers his abundance on you.

Yours truly,

Anthony Writer

Hi Christopher,

I have the impression that this situation could very well be the direct result of the fact that Johnny did not inform Anthony explicitely about that regarding the 'history' section at Johnnny's website... the copyrights belong to you.

So far I think I must conclude that Johnny did not protect your work in his email conversations with Anthony - looks like Johnny did not mention your name at all. And therefore I hope that Anthony will not blame himself too much for making the mistake.

wave

PS. I actually think Johnny's website presents confusing information regarding where the copyrights belong, because e.g. there is no copyright notification on Johnny's homepage.

At the 'History of Hand Reading' section he does mention: 'Authored by Christopher Jones MA (Oxon)'... but the copyright statement found elsewhere on that page (http://www.johnnyfincham.com/history/index.htm) does not mention your name.

Now it may look like that the statement claims that the owner of www.johnnyfincham.com has the copyrights.

This potential point of confusion would not occure if the article on Johnny's website would have stated:

"©️ All written material remains the copyright of Christopher Jones MA (OX)"

And finally, because somewhere in the email conversations between Johnny and Anthony... Johnny allowed Anthony to use his 'materials' (without any specification regarding the parts that belong to you, and without ever mentioning your name)... I am not surprized at all that Anthony assumed (incorrectly) that he was allowed to use all materials presented at Johnny's website.

PPS. I hope you have noticed that Anthony has deleted his SCRIPD account + all files. So, I think the problem is already sort of solved now, except that Johnny may not be aware of how his answers to Anthony's questions likely have caused the problem...???.
